Terms of Service
Last updated 30 September 2026
These terms are the agreement between you and Qrains when you use it to run a business. We have kept them as short and plain as we can. If something here is unclear, ask us before you sign up.
01The agreement
These terms are between Qrains (“Qrains”, “we”) and the business that signs up (“you”). By creating an account or using Qrains you agree to them. You must be at least 18 and able to bind your business. If you join a workspace someone else created, these terms apply to you, and that business is responsible for what happens in it.
Qrains is in an early stage, and some features may change or be withdrawn while we pilot it. We will tell you about changes that affect you.
02What Qrains does
Qrains runs parts of a business for you: it answers calls and messages, books jobs, keeps a schedule, sends invoices and reminders, and asks you only when a decision is yours. It does this through AI agents working inside a business description (a “template”) that you choose and customise. Agents can only do what the template’s actions and rules allow, and what you have approved.
03Your account and team
- Keep your sign-in secure. You are responsible for what happens under your account and for the people you invite and the roles you give them.
- Give accurate details about yourself and your business, and keep them up to date.
- Tell us promptly if you think someone has got into your account.
04Your business, your responsibility
You decide how your business runs: your services, prices, rules, limits and who approves what. The agents follow that. So you are responsible for:
- what you configure, publish and approve, and for checking that it is right before it goes live;
- the accuracy of what you tell customers (prices, availability, terms), and keeping any licences, permits and insurance your work needs;
- following the laws that apply to your business, including consumer, tax, employment and data protection law;
- making sure your customers know they are dealing with an AI assistant, wherever the law requires it.
Qrains is not your lawyer, accountant, doctor or adviser. It does not give professional advice.
05AI can be wrong
The agents use AI models, which can make mistakes, misunderstand a customer, or be misled. We build in limits (actions and rules that are checked in code, and approvals for what you choose) so a mistake cannot exceed what you allowed, but we cannot promise the agents are always right. Set the approvals and limits that match what you can afford to get wrong, and review your history. Do not use Qrains for decisions that could seriously harm someone, or as an emergency line.
06Calls and WhatsApp
- Qrains uses WhatsApp and phone calls only. You may only contact people who are entitled to hear from you: customers who reached out, or who gave the consent the law requires. No cold outreach, and no bulk or unsolicited messages.
- You must follow Meta’s terms and policies for the WhatsApp Business Platform and the rules of the phone networks. Meta or a carrier can limit or suspend an account, and we are not responsible for that or for outages on their side.
- We honour opt-outs (for example “STOP”). Do not try to get around them.
- Phone lines. Each business has a phone line, bought from us as an add-on, charged at our provider’s cost plus a small fee. Some countries need regulatory documents first, and we collect them before you pay. The line is charged in advance before its provider renews it. If it is unpaid the number is released, and you have no ownership of a number beyond the right to use it while it is paid for.
07What you may not do
- Break the law, or use Qrains to deceive, harass, threaten or impersonate anyone.
- Send spam or unsolicited messages, or use Qrains to contact people who have not agreed to hear from you.
- Put in data you have no right to use, or data of a kind we say we do not handle: payment card numbers, government ID numbers, or health information (unless we have agreed it in writing).
- Use Qrains for anything that needs it to be fail-safe (for example emergency services, or medical decisions).
- Try to break, overload, probe or reverse-engineer the service, get around limits, or copy the platform or its catalogue.
We may suspend anything that breaks this section, and will tell you why when we can.
08Your data
You own your business data and your customers’ records. You give us permission to process them only to provide the service to you. For personal information about your customers, we act as your processor. You can export your records at any time. When your workspace closes, we delete its data within 30 days, except what the law requires us to keep. How we handle personal information is in our Privacy Policy.
We do not use your data to train AI models.
09Fees and payment
- Plans and prices are on our pricing page. Plans are billed monthly in advance. The phone line and any usage beyond your plan are extra, as shown when you choose them.
- Fees are in the currency shown and do not include taxes, which you pay where they apply.
- If a payment fails we will tell you, and may pause the service until it is paid.
- We will give at least 30 days’ notice before a price change affects you.
- Fees already paid are not refunded, except where the law requires it. You can cancel at any time; your plan then ends at the close of the billing period you have paid for.
10Ending the agreement
You can cancel at any time in your account; it ends at the end of the period you have paid for. We may suspend or end your account if you break these terms, do not pay, or if we must by law, and we will give notice where we can. Sections that by their nature should continue (payment owed, ownership, liability, disputes) do.
11Who owns what
We own Qrains, its code, and its catalogue of templates and customisations. While you subscribe we give you a right to use them to run your business. You own what you put in and what you configure for your business. If you give us feedback we may use it freely.
12Other companies’ services
Qrains works with services from other companies, such as Meta, phone networks, payment providers and AI model providers. Their terms apply to their parts, and we are not responsible for them.
13No guarantees
Qrains is provided “as is” and “as available”, and because it is in an early stage we do not promise it will always work without interruption or error, or that it will earn you money or save you a set amount of time. The law may give you rights that cannot be removed; these terms do not remove them.
14Limits on our liability
To the extent the law allows, we are not liable for indirect or consequential losses, lost profits, lost business or lost data, and our total liability for anything arising from Qrains is limited to the fees you paid us in the 12 months before the event. Nothing limits liability that the law does not allow to be limited.
You agree to cover us for claims from third parties (including your customers) that come from what you configured, published or said through Qrains, or from your breach of these terms or the law.
15Disputes and governing law
These terms are governed by the law of Kenya. We will try to settle any dispute in good faith first; if we cannot, it will be heard in the courts of Nairobi, Kenya. Where the law of your country gives you the right to go to your local court, that right stays.
16Changes to these terms
We may update these terms. For changes that matter we will email the account owner at least 30 days before they apply. If you keep using Qrains after that, you accept them; if you do not, you can cancel.
17General
These terms and the documents they point to are the whole agreement. If part of them cannot be enforced, the rest still applies. We may assign the agreement as part of a sale of the business, but you may not without our consent. Notices go to the email on your account, and to us at qrainsaisupport@gmail.com.
